<p><strong>As you know in western bank accounts, there is now a requirement to keep a certain amount of money in your checking account to avoid maintenance fee. Do we have to pay khums on those amounts?</strong></p>

										<content:encoded><![CDATA[<p>Is khums due on the money deposited into an employee savings account, such as a 401-K or IRA account? The savings in these accounts increase over time as a small percentage is taken from the employee’s salary and the employer adds a similar percentage to it. Both are then invested, and the entire savings are given to the employee upon retirement.</p>
<p>Khums is immediately due on the percentage that is contributed from the employee’s salary. On the other hand, the amount contributed by the employer and the investment profits are not subject to khums until received by the employee and they have exceeded the expenses for the year of receipt.</p>

										<content:encoded><![CDATA[<p>Believers pay Zakat al-Fitrah at Islamic centers in the West by placing it in designated boxes before performing Eid prayers in order to deliver it to the deserving poor among the believers. If the total amount of funds exceeds the need or the deserving poor believers in the area are few, is it permissible to spend it on the development of Islamic centers or the expenses of some of the educational and outreach initiatives and programs?</p>
<p>Zakat al-Fitrah is spent exclusively on the poor believers based on obligatory precaution and is not permissible to be spent on other charitable causes. It can be transferred to poor believers in other regions; however, it is better to give it to the jurist (marja).</p>

										<content:encoded><![CDATA[<p>A woman has a lot of clothes, jewelry, accessories, bags, and shoes. Is it obligatory upon her to pay khums on these items? In the event she is required to pay khums on them but postponed it to another time, is it permissible for her to use them [in the meantime]?</p>
<p>Khums is due on possessions that exceed what is commonly understood to be suitable for the status of the person based on their standard of living. Therefore, if any items become liable for khums based on this criteria, then she must refrain from using them until the khums for them are paid. Additionally, it is not permissible to postpone payment [of khums] without the permission of the jurist or his authorized representative because it is considered an unlawful usurpation.</p>

<p>Based on obligatory precaution, the person is not absolved of paying Zakat al-Fitrah even if they failed to do so [for many years]. They must still fulfill this duty with the intention of seeking general nearness (qurbah mutlaqah) to God and not with an intention of it being in its required time (ada) nor that it is lapsed (qada).</p>

<p>1. Gold that was part of a dowry is exempt from khums.</p>
<p>2. Gold that was purchased with money from which khums has already been paid is exempt from khums.</p>
<p>3. Gold that suits the woman’s shan or standard of living as determined in Islam, which was received as a gift or purchased with money from which khums has not been paid but was worn for some time during the year (even if it was left unused in the second year) is exempt from khums.</p>

Gold that suits the woman’s shan or standard of living as determined in Islam, which was received as a gift or purchased with money from which khums has not been paid, and was worn periodically during the year in which it was received, but was then unused for the remainder of the first year, then khums must be paid on it based on obligatory precaution.</p>
