										<content:encoded><![CDATA[<p>Is it obligatory for the community of believers in non-Muslim countries to establish a private cemetery for burying their dead, especially since transporting bodies abroad may conflict with some religious rulings, such as drawing blood or removing the tissue from the body of the deceased, or if transportation constitutes a financial burden on the family of the deceased? How does one deal with the body of a dead Muslim who has no guardian or who has a guardian but does not abide by the Islamic code of law?</p>
<p>The guardian (wali) must prepare the deceased Muslim and bury them in a suitable place, other than a non-Muslim cemetery. If they do not have a guardian, or their guardian refuses to carry out the burial or is unable to do so, then it is obligatory upon all Muslims to carry it out [if one carries it out the obligation is lifted from the rest]. If fulfilling this communal duty requires procuring a piece of land in advance and making it a cemetery by purchasing it, then it is necessary to do so.</p>

										<content:encoded><![CDATA[<p>Some doctors consider brain death to be the measure of a person’s actual death; even if the heart does not stop beating immediately, they conclude that it will inevitably stop after a while. What is the religious view on this matter? What if the patient remains in such a state under artificial respiration for a long time that it costs the patient’s family an exorbitant amount of money which they are unable to pay? Moreover, if they are unable to pay the treatment bills, healthcare and services will be withdrawn from the patient and result in their death?</p>
<p>The criterion for applying the term “dead” to a person insofar as the application of religious laws is concerned is when the average person considers them dead based on common view (urf). Yet, this criterion is not established based on what the question states. Moreover, if the patient&#8217;s family is not able to provide the treatment fees, then others must provide them, such that everyone who can afford it must contribute to sustaining the life of a Muslim. Similarly, a Muslim doctor must also refrain from turning off the life support equipment from the patient, and it will not harm them [they will not be held responsible] if someone else does.</p>

										<content:encoded><![CDATA[<p>A believer died in the West and their will directs that their body should be transported for burial to their native country. However, the deceased&#8217;s relatives are surprised to encounter strict rules and procedures for transporting bodies, such as withdrawing the blood and replacing it with preservative/embalming chemicals and repeatedly exposing the body to the opposite gender. In addition, the procedures are lengthy and can take approximately two weeks until the body is finally buried. In such a case, should the will be executed, especially since the country where the person died has cemeteries for Muslims and designated places where the deceased’s relatives and the rest of the community of believers are already buried?</p>
<p>Withdrawing blood from the deceased and similar procedures are not permissible. Therefore, the will&#8217;s directive to transfer the body to the native country is not valid (i.e., not executable) if it requires such prohibited procedures.</p>

										<content:encoded><![CDATA[<p>My grandmother has dementia that is very advanced and irreversible. She cannot make healthcare decisions for herself, so I have to make it for her. Her dementia is so advanced that she does not recognize her own family members, does not eat food or drink water (except maybe once a day), and she is also incontinent. </p>
<p>1. If her heart were to stop due to natural causes, is it required to perform CPR on her and also place a breathing device. The chance of her surviving is very low with these procedures, and it will result in a great deal of pain. Is it Islamically appropriate for me to deny resuscitation and life-support? </p>
<p>2. I would like to place my grandmother in hospice care, where they try to make the patient as comfortable as possible, but do not give them any medications that will increase their life. For example, if she has high blood pressure, they will stop giving her high blood pressure medicine in order to avoid the side effects of these drugs. Instead, they will give her only medicine that will decrease her anxiety and pain. These medicines will calm her down and allow her to relax as she passes away naturally from her advanced dementia. Is it Islamically permissible for me to place her in such a facility?<br />
1. It is obligatory to take all possible measures to keep the patient alive, even if it results in their pain, because preserving their life is a priority.</p>
<p>2. There is no problem in placing her in the hospice, provided that doing so does not lower her chance of survival. Moreover, it is your obligation to make sure your mother is in good hands, and that she is safe with good treatment, and you feel reassured that you fulfilled her rights as expected by Islam.</p>

										<content:encoded><![CDATA[<p>What is the religious significance of soyem (third day after death) and Arbaeen (40 days after death). We usually arrange a family gathering in these days and pray for the forgiveness of the deceased.</p>
<p>Arranging a gathering for reciting the Holy Quran and praying for the forgiveness of the deceased is a recommended practice in Islam that can take place any day of the year. As for designating a day like the 3rd, 7th, or 40th, or after one year, these are cultural norms, and since they do not conflict with the teachings of Islam, it is permissible to hold and attend such gatherings.</p>

<p>You can allocate something for them as a gift from one-third of the estate or tarika only, or you can give it to them now in the form of a gift and you can distribute it in any way you like while you are still living.</p>
