Is it permissible for a woman whose husband is completely sterile to use a sperm bank (a repository of sperm samples from various men that are frozen and then donated to those who need it) to fertilize her ovum in order to have children?

It is not permissible for a man to transfer sperm to the uterus of a woman other than his wife for fertilization inside the womb. It is permissible if the fertilization [of the wife’s ovum with her husband’s sperm] takes place in a test tube and the fertilized ovum is then implanted in the womb of someone other than the wife, although this should be avoided based on recommended precaution.

In both cases, the child is legitimate. As for lineage, the sperm donor is the father, whereas it is problematic to identify either the ovum-donor or the woman who carried the child during pregnancy as the mother. Therefore, precaution must be observed in terms of the religious rulings related to the male offspring’s status as brother and/or son. However, the child and the woman who carried the pregnancy are mahram to each other even if he might not be technically considered her son.

Is obedience to one’s parents obligatory or recommended? Sometimes children discuss vital and essential matters about their future with their parents, including what to study, type of work, travel, marriage, etc., and the discussion may become so intense that the parents become distressed by it. Is it permissible for the children to do so? If it is not permissible, what is the limit the children must not exceed?

It is permissible for children to discuss matters with their parents in which they disagree with their opinions. However, they must be calm and polite, and not look at them disrespectfully or even raise their voice over theirs, let alone use harsh words. Obeying one’s parents is recommended, but if disobedience causes the parents distress, due to their compassion for their children, then it is not permissible [to disobey].

Is DNA testing permissible and legitimate to rely upon to identify a child’s biological father?

If the test shows that the DNA/genetics of a child and man match, then the results should be considered accordingly because the criteria for the ruling upon which a newborn is confirmed as the offspring of a certain man is based on its formation from his sperm. Thus, the [subsequent] rulings for that child as the man’s offspring would be based on that.

Is it permissible for a pregnant woman to exercise freedom over her body by aborting her fetus if it was conceived by mistake or if medical examination indicates that the fetus is disabled, such as having Down syndrome?

A person’s freedom over their body is only limited to what is permissible in Islamic law. As such, it is not permissible for a pregnant woman to abort her fetus unless the pregnancy poses a danger to her life or results in unbearable hardship (even if the unbearable hardship is due to caring for the child after birth). Then abortion is permissible before the soul enters the body (the 4th month, if it has not been proven to happen before then by modern means). As for after the entry of the soul, abortion is not permissible based on obligatory precaution. Moreover, the mere statement of the doctor or medical reports of the fetus being deformed or disabled is not a justification for abortion.

Children may disagree with their parents in many matters, including travel, marriage, choosing a university major, a professional trade, and other similar decisions. What are the limits of obedience to the father and the mother?

The first, which relates to the affairs of the parents, includes two kinds of duties:

1- Being good to their parents, by fulfilling their daily and financial needs, and meeting the normal and usual demands of their lives such that it would be regarded as a denial of their favors [upon the child] if neglected.

2- To behave with them in an acceptable manner by not offending them through words or actions, even if the child feels that they have been wronged by them.

The second aspect includes two types of duties that relate to the affairs of the child and the decisions and actions that cause the parents distress, which results from:

1- The parents’ compassion and concern for their child. As such, it is forbidden for the child to do something that would cause them distress, irrespective of whether or not they have forbidden them from it.

2- The parents’ own reprehensible characteristics (e.g., they do not want what is good for their child, possibly for personal reasons) then it is not obligatory upon the child to submit to their desires of this kind.

Is it permissible for parents to spend the money of their non-baligh child?

It is permissible for the father to spend the money if it is not detrimental to the child. As for the mother, she does not have the right to spend the child’s money without the permission of the father or paternal grandfather. However, she may do so if either of them gives permission and it is not detrimental to the child. But it is not permissible for either parent to spend the money if the consequences are harmful to the child. Instead, they must save the money for the child until they are older.
